Qlooto
Draft — reflects the platform’s designed behavior but has not had a licensed-lawyer review. Do not treat this page as final before go-live.

Terms of Use

This is a working draft that reflects the platform's design decisions as agreed in the concept document. It is not legal advice and must be reviewed by a licensed Indian lawyer before go-live (concept doc §10a names this as a hard gate — do not launch on this draft unreviewed).

1. What Qlooto Real Estate Is

Qlooto Real Estate ("the Platform") is a non-profit, community-run space where prospective and current homebuyers share first-hand information — questions, answers, milestone reports, and experiences — about specific real estate projects in India. The Platform is not a broker, developer, advisor, or party to any real estate transaction, and does not receive payment from developers or brokers for placement, ranking, or visibility (concept doc §9).

2. Who Can Use It

You must be at least 18 years old and capable of entering a binding agreement under Indian law to create an account. The Platform is not directed at, and does not knowingly collect data from, anyone under 18.

3. Your Account

  • You choose a pseudonymous handle. You are not required to use your real name, and your real name is never shown publicly (concept doc §8, §7).
  • You are responsible for keeping your login credentials confidential and for all activity under your account.
  • One account per person. Creating multiple accounts to inflate activity, votes, or apparent consensus is a violation of these Terms (concept doc §10a's anti-gaming design) and may result in suspension.

4. Verification

  • You may choose to verify a purchase or booking by submitting a supporting document (e.g., an allotment letter or agreement).
  • Documents are used only to confirm the match between you and the stated project/unit type, and are deleted immediately after that check — the Platform does not retain a copy (see the Privacy Policy §4 and architecture doc §4 for how this works technically).
  • Verified status is shown as a badge; the document itself, and any personal details on it, are never displayed publicly or to other users.

5. Content You Post

You, not the Platform, are responsible for what you post. By posting, you confirm that:

  • What you're sharing is your genuine, first-hand experience or a good-faith question — not something you know to be false.
  • You are not posting on behalf of a developer, broker, or any commercially interested party without disclosing that interest.
  • You are not posting anyone's private information (address, phone number, ID numbers) without their consent, and not naming or targeting a specific individual (as opposed to a company) in a complaint.
  • You are not posting content that is defamatory, threatening, obscene, or otherwise unlawful under Indian law, including the Information Technology Act, 2000 and its Rules.

What you must not post. As the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 require, you must not post, upload or share anything that:

  1. belongs to another person and that you have no right to share;
  2. is obscene, pornographic, paedophilic, invasive of another person's privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, relates to or encourages money laundering or gambling, or promotes enmity between groups on grounds of religion or caste with the intent to incite violence;
  3. is harmful to children;
  4. infringes a patent, trademark, copyright or other proprietary right;
  5. deceives or misleads anyone about where a message came from, or knowingly and intentionally spreads misinformation or information that is patently false or misleading;
  6. impersonates another person;
  7. threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order; incites any cognisable offence; prevents the investigation of any offence; or insults another nation;
  8. contains a software virus or any other code, file or program designed to interrupt, destroy or limit the functioning of any computer resource;
  9. is an online game, or an advertisement or promotion for an online game, that is not a permissible online game under Indian law;
  10. violates any law for the time being in force.

This includes anything created or altered with AI or other tools and presented as real.

The Platform operates a notice-and-takedown model: you are responsible for what you post, and the Platform acts on content once it is reported or ordered removed (see §8). Photos can be held for review, by our team or automatically, before others see them. Any post can be reported, and a report of nudity, sexual content or child abuse hides the post straight away until it is reviewed. Child sexual abuse material is removed and reported to the authorities.

6. Developer Right of Reply

Any project or developer named in a post may submit a factual response, which is published alongside the original content rather than used to have it removed (unless the original content itself violates these Terms). This is a structural safeguard described in the concept document (§10a) and detailed in the Moderation Playbook.

7. What the Platform Does Not Guarantee

  • The Platform is a space for peer-shared information, not verified fact, professional advice, or a substitute for your own due diligence, legal counsel, or the official RERA record for a project.
  • Trust scores and dimension ratings shown on a project page are computed from community-submitted reports using a published methodology (see the Trust Score Spec) and reflect contributor-reported experience, not an audit or guarantee of any kind.
  • The Platform does not verify the truth of every individual post; it verifies contributor identity/purchase status (where a verified badge is shown) and moderates per the published process.

8. Moderation, Flagging, and Removal

  • Any user can flag content with a specific reason. Flags are reviewed against a published, consistent set of criteria (see the Moderation Playbook), not ad hoc judgment.
  • The Platform may remove content, suspend, or terminate an account that violates these Terms, is subject to a valid legal order, or is found to be commercially motivated without disclosure.
  • If you believe you are facing retaliation for something you posted, a dedicated fast-tracked report channel exists — see the in-app reporting option.
  • Response times. Reports are reviewed within 24 hours. Reports of nudity, sexual content or child abuse hide the post at once and are reviewed within 2 hours. Valid orders from a court or an authorised government agency are acted on within the time the law sets (currently 3 hours).
  • Consequences. Breaking these rules can lead to removal of the content and suspension or termination of the account. Posting unlawful content may also be an offence under the Information Technology Act, 2000 and other laws, and we report it to the authorities where the law requires.
  • We remind every member of these rules at least once every three months.

9. Grievance Officer

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, a Grievance Officer is designated to receive and act on complaints about content on the Platform.

Manoj Singh, Grievance Officer
Qlooto Technologies, B-75, Sector 63, Noida, Uttar Pradesh 201301
Email: grievance@qlooto.com

To complain about content or an account, email the Grievance Officer with a link to the post or profile and what the problem is. We acknowledge complaints within 24 hours and resolve them within 7 days. A complaint asking for unlawful content to be removed is acted on within 36 hours, and a complaint about content that shows you, or someone you complain for, nude, in a sexual act or impersonated in such content is acted on within 2 hours. If you are not satisfied with the outcome, you may appeal to the Grievance Appellate Committee under the IT Rules, 2021 within 30 days.

All our contact addresses are on the Contact page.

10. Intellectual Property

You retain ownership of what you post. By posting, you grant the Platform a non-exclusive, royalty-free license to display, distribute, and archive that content on the Platform (including in aggregated or anonymized form, e.g., trust scores) for as long as your account or the content remains active, consistent with the deletion rights described in the Privacy Policy.

11. Termination

You may delete your account at any time. As the IT Rules require, your handle and email are then kept sealed for 180 days (only for a lawful request from a government agency) and then erased. The Platform may suspend or terminate access for violation of these Terms, illegal activity, or at its discretion where continued access would create legal or safety risk, with notice where practicable.

12. Limitation of Liability

[ Standard liability-limitation clause — to be drafted by counsel; a non-profit community platform still needs enforceable limits on liability for user-generated content, service interruption, and reliance on posted information. ]

13. Governing Law

[ To be confirmed by counsel, expected to be the courts of [City], India, given the Platform's NCR focus and operating base. ]

14. Changes to These Terms

Material changes will be announced in-app before they take effect, and continued use after that point constitutes acceptance. The version of these Terms you agreed to at signup is recorded (concept doc §7b).

Open items before this can go live: governing-law clause (§13), liability limitation (§12), and full legal review of the entire document.
